# Terms of Service

These Terms of Service ("Terms") govern your access to and use of docs.page (the "Service"), a documentation hosting platform operated by Invertase Limited ("Invertase", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

## 1. The Service

docs.page is a docs-as-code platform that renders documentation websites from Markdown and MDX files stored in a connected source code repository (for example, on GitHub). The Service reads content and configuration from a repository you designate and serves it as a hosted documentation site.

We may add, change, or remove features of the Service at any time. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.

## 2. Eligibility and Accounts

You may need to authenticate through a third-party provider (such as GitHub) to use certain features, including connecting private repositories or accessing a dashboard. You are responsible for activity that occurs under your account and for keeping your credentials and connected accounts secure. You must be capable of forming a binding contract to use the Service.

## 3. Your Content

"Your Content" means the documentation, text, images, code samples, configuration, and other materials you make available through a repository connected to the Service.

- **Ownership.** You retain all rights you hold in Your Content. These Terms do not transfer ownership of Your Content to us.
- **License to operate the Service.** You grant us a worldwide, non-exclusive, royalty-free license to access, host, cache, reproduce, and display Your Content solely as necessary to provide and operate the Service.
- **Your responsibilities.** You are solely responsible for Your Content, including that you have the necessary rights to it and that it does not infringe the rights of others or violate any law. You are responsible for the repository permissions and visibility settings that determine what the Service renders publicly.

## 4. Acceptable Use

You agree not to use the Service to:

- publish or distribute unlawful, infringing, deceptive, or harmful content;
- violate the intellectual property, privacy, or other rights of any person;
- attempt to gain unauthorized access to the Service, other accounts, or related systems or networks;
- interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure, including through automated scraping or excessive requests;
- distribute malware or use the Service to host content intended to facilitate harm;
- misrepresent your affiliation with any person or organization.

We may investigate and take appropriate action, including removing content or suspending access, for any use that we reasonably believe violates these Terms.

## 5. Intellectual Property

The docs.page software is open source and made available under the Apache License 2.0; your use of the source code is governed by that license. These Terms govern your use of the hosted Service, not the software license.

The "docs.page" and "Invertase" names, logos, and brand features are the property of Invertase Limited and may not be used without our prior written permission. Nothing in these Terms grants you any right to use them except as expressly permitted.

## 6. Third-Party Services

The Service integrates with third-party services, including source code hosting providers such as GitHub. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them. Availability of the Service may depend on those third parties.

## 7. Privacy

Our handling of personal data is described in our [Privacy Policy](https://use.docs.page/legal/privacy). By using the Service, you acknowledge that information will be handled as described there.

## 8. Disclaimers (Provided on a Best Endeavours Basis)

docs.page is a free community service provided on a 'best endeavours', 'as is', and 'as available' basis. To the maximum extent permitted by law, we exclude all implied terms, conditions, and warranties (including any warranties implied by the Supply of Goods and Services Act 1982 or common law regarding merchantability, satisfactory quality, or fitness for a particular purpose).

We do not warrant that the Service will be uninterrupted, error-free, secure, or that documentation will always be accessible. If you require guaranteed uptime or commercial-grade service level agreements (SLAs), you should not use this free Service.

## 9. Liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded or limited under the laws of England and Wales.

The Service is provided to you entirely free of charge. Subject to the overriding protections above, and to the maximum extent permitted by law, Invertase Limited will not be liable to you under or in connection with these Terms — whether in contract, tort (including negligence), breach of statutory duty, or otherwise — for any:

- loss of profits, sales, business, or revenue;
- loss of data, production, or reputation; or
- indirect, special, or consequential loss.

Our total aggregate liability to you for any single or series of claims relating to the Service shall not exceed £0.

**Consumer Carve-Out:** If you are an individual developer using the platform for personal/hobbyist use outside of your trade, this cap does not affect your rights under the UK Consumer Rights Act 2015.

## 10. Indemnification

If you use the Service in the course of a business, trade, or profession, you agree to indemnify and hold harmless Invertase Limited and its affiliates from any third-party claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content or your breach of these Terms.

If you are an individual hobbyist consumer, you are responsible to us only for foreseeable losses or damages we directly suffer as a result of your deliberate breach of these Terms or your violation of applicable law.

## 11. Termination

You may stop using the Service at any time by disconnecting your repository or account. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or to protect the Service or other users. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

## 12. Changes to These Terms

We may update these Terms from time to time. For any material changes, we will provide at least 14 days’ advance notice by updating the "Last updated" date above and posting a notice on the platform. If you do not accept the changes, your sole remedy is to stop using the Service and disconnect your repositories before the notice period expires.

## 13. Governing Law

These Terms are governed by the laws of England and Wales, without regard to its conflict-of-laws rules. The courts of England and Wales will have jurisdiction over any dispute arising out of or relating to these Terms. If you are a consumer residing in Scotland or Northern Ireland, you may also bring legal proceedings in your respective local courts.
